1. About these terms

These Terms of Use (“Terms”) are an agreement between you and Shopispace (“we”, “us”) for the use of the Shopispace website, the merchant dashboard, the hosted stores and the related tools (together, the “Service”). By creating an account or using the Service, you accept these Terms. If you do not accept them, do not use the Service.

If you use the Service for a business, you confirm that you can bind that business to these Terms. You must be old enough to enter into a contract: under Algerian law, 19 years or more.

Our Privacy Policy explains how we handle personal data and is part of these Terms.

2. What Shopispace provides

Shopispace lets merchants build an online store and landing pages, take cash-on-delivery orders, confirm them, send them to delivery companies, filter out fake orders, create product images and text with AI, and connect advertising pixels, webhooks and notifications. The features you can use depend on your plan.

We keep improving the Service and may add, change or remove features. We will try to give you notice before we remove something you rely on.

3. Your account

  • Give accurate information when you sign up and keep it up to date.
  • Keep your password, passkeys and access links safe. You are responsible for everything done through your account, including by your team members. Tell us at once if you suspect unauthorised use.
  • The owner of a store decides who joins the team and with which role, and is responsible for them.
  • Each person gets one free trial. Creating other accounts to get more trials is not allowed.
  • Your account is personal to you. You may not transfer it without our agreement.

4. Plans, free trial and payment

  • Free trial. A new store starts with a free trial. Its length and the plan it unlocks are shown on our website when you sign up, and no payment card is needed.
  • Plans. Paid plans are priced in Algerian dinars (DZD) per month. The price, the monthly order allowance and the limits (team members, advertising pixels, products) are shown in the pricing section of our website. You can buy 1, 3, 6 or 12 months at a time.
  • Paying. You pay by card through our payment provider, or in cash by arrangement with us. Your plan period starts or is extended only once we have confirmed the payment. Plans do not renew automatically: you extend by paying again.
  • Extra orders. Where a plan allows orders beyond its monthly allowance, they are charged to prepaid credit that you buy in advance. Otherwise your store stops taking orders until the next month, or until you move to a larger plan. Credit spent on an order is not returned if that order is deleted later.
  • When a paid period ends, your store moves to the free allowance (or to none, if we have closed it), which has lower limits. Your data is kept, but capacity and features beyond those limits stop until you pay again.
  • Changes. We may change prices and plan limits. A change applies to periods bought after it; a period you have already paid for is not affected. Discount codes apply as stated when you enter them.
  • Refunds. Unless the law requires otherwise, a payment is not refundable once its period has started. If you think you were charged by mistake, contact us and we will look into it.

5. Your store and your shoppers

You are the seller. Your store, products, prices and orders are your responsibility, and so is your relationship with your shoppers. You agree to:

  • list only goods and services that you are allowed to sell and able to deliver, with accurate descriptions, prices, delivery fees and delivery times;
  • handle orders, delivery, returns, refunds and complaints properly, in line with Algerian consumer protection law and the rules on electronic commerce, and register your business and pay your taxes as the law requires;
  • treat shoppers’ data lawfully: tell them what you collect and why, use it only to process and deliver their orders and for other purposes they agree to, keep it secure and respect their rights. Where Law 18-07 or another data protection law applies, you are the controller of that data and you are responsible for any declaration or authorisation the authority requires;
  • follow the rules of the delivery companies and advertising platforms you connect;
  • not use any feature, including country-based page rules, to deceive shoppers, payment or delivery partners, advertising platforms or authorities.

6. Data we process for you

For the orders and customer details collected by your store, you decide the purpose and we process the data on your behalf and on your instructions: to host the store, show you the orders, protect against fake orders, and pass details on to the delivery company, advertising platform, messaging chat or webhook that you connect.

We apply the security measures described in our Privacy Policy, let our staff reach the data only when needed (for support or security), use the service providers listed there, and help you answer shoppers’ requests as far as we can. You can delete orders and customer records in your dashboard. When your account is closed, we delete the store data as the Privacy Policy describes, so keep your own copy of what you need.

7. Acceptable use

You must not use the Service to:

  • break the law, or sell goods or services that are illegal in Algeria or in the country you sell to, counterfeit, stolen or dangerous goods, or goods that the platforms we connect to forbid;
  • publish content that infringes the rights of others, or is defamatory, deceptive, hateful or obscene;
  • send spam or fake orders, or commit fraud or phishing;
  • attack, overload or probe the Service, get around its limits or security, or reach other people’s stores or data;
  • scrape, copy, resell or reverse-engineer the Service, except as the law allows;
  • harm shoppers, other merchants, or our delivery and payment partners.

We may remove content or suspend a store that breaks these rules (see “Suspension and ending”).

8. Your content and our rights

You keep ownership of what you upload or create in your store (products, texts, images, pages), “Your Content”. You give us a non-exclusive licence to host, copy, display, transmit and process Your Content as needed to run the Service for you, for as long as you use it. You promise that you have the rights to do so.

Text and images made with AI tools are suggestions. They can be wrong or look like other people’s results. Review them before you publish: you are responsible for what appears in your store. AI image edits arrive as drafts, and nothing goes live without your approval.

Shopispace, its name, logo, software, designs and documentation belong to us or our licensors. These Terms give you the right to use the Service, not to own it. Stores may show a “Built by Shopispace” link.

9. Third-party services

The Service connects to services run by others: delivery companies, payment providers, advertising platforms, AI services, messaging services and our hosting providers. Their own terms and fees apply to your use of them. You are responsible for the credentials you give us, for charges made by them (for example on your own AI API key), and for checking what they report.

We do not control them and are not responsible for their services, outages, delays, errors or decisions, such as a delivery company losing a parcel or an advertising account being restricted. Delivery and the collection of cash are carried out by the delivery companies you work with, not by Shopispace.

10. Availability and support

We work to keep the Service available, but we cannot promise that it will be uninterrupted or free of errors. We may pause it briefly for maintenance. Tracking updates come from the delivery companies and can arrive late.

You can reach support by phone and WhatsApp (see “Contact”).

11. Suspension and ending

  • You can stop using the Service at any time. To close your account and have your data erased, contact us. Stopping does not entitle you to a refund of a period already paid, subject to the law.
  • We may suspend or end your access, immediately where needed, if you break these Terms, do not pay, put others or the Service at risk, or if the law requires it. Where we can, we will tell you why and give you a chance to fix the problem.
  • After an account is closed we delete store data as the Privacy Policy describes. Provisions that by their nature should continue, such as payment obligations, ownership, limits on liability and governing law, continue.

12. Warranties and liability

To the extent the law allows, the Service is provided “as is” and “as available”. We do not promise that it will meet every need, produce any particular sales or advertising result, or be free of errors.

To the extent the law allows, we are not liable for indirect or consequential loss, lost profits, lost sales or orders, or loss of goodwill arising from the use of the Service. Our total liability to you for all claims related to the Service is limited to the amount you paid us in the 12 months before the event that gave rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Algerian law, including liability for fraud or deliberate wrongdoing.

13. Claims against us

You will compensate us for claims, losses and costs brought by third parties, including shoppers and authorities, that arise from Your Content, your products and orders, or your breach of these Terms or of the law, to the extent you caused them.

14. Changes to these terms

We may update these Terms. The new version is posted on this page with its date. For significant changes we tell you through the dashboard or by email before they apply. If you keep using the Service after a change takes effect, you accept the new Terms; if you do not agree, stop using the Service and contact us to close your account.

15. Governing law and disputes

These Terms are governed by Algerian law.

If a dispute arises, write to us first and describe the problem; we will try to settle it amicably. If that fails, the competent courts in Algeria have jurisdiction.

These Terms are available in English, French and Arabic. If the versions differ, the Arabic version prevails for users in Algeria and the English version elsewhere.

16. General

  • These Terms and the Privacy Policy are the whole agreement between you and us about the Service.
  • If part of these Terms is found invalid, the rest stays in force.
  • Not enforcing a right does not mean giving it up.
  • You may not assign these Terms without our agreement. We may assign them to a successor of our business.
  • Neither of us is liable for a delay caused by events beyond reasonable control, such as a power, network, delivery-company or payment-provider outage, or a change in the law.
  • We may send you notices by email, through the dashboard or by posting them on our website.
